Default Payroll parctice vs. wefare benefit, Help!

Ok, I have filed an ERISA lawsuit against my former company and Sedgwick CMS. I was out of work for 3 1/2 months. The last 4 weeks of that was paid to me then withheld when I got back to work because I had no medical evidence that anything was wrong with me. I discovered I had a disability that is corrected with diet. A month after I went back to work I got the right doctor to take the right blood-work and confirm my medical condition. The same date (jan 5, 200 Sedgwick cms appeals unit denied my one and only appeal. I am now in federal courts with the question if Celiac Disease qualifies for a STD. They are contending they are mearly a third party adm and have nothing to do with this case and are arguing this is a payroll practice and nothing more, even though the std policy states 13 weeks 100% pay then 13 weeks 60% pay. can anyone help me? Should I pursue this in state court?

Would love to know how this went - sorry I didn't see it when you posted. I just won a 6 year pro se battle for my ERISA disability benefits. I hope I can help you with this.
