payments on medical bills
Could someone please offer advice on what Georgia Law states about making medical payments to providers. I called a local hospital to make my first payment on my medical bills incurred there. I was not delinquent at that time. I was informed that I couldn't make minimum payments of $36.00 per month. I had to pay at least $46.00 per month. I politely stated that I could not afford to pay that much per month because I was trying to pay various other medical bills. I reluctantly agreed (by phone) to that amount because I was told that I had no other choice. If I didn't agree then the entire amount would be due immediately and after 60 days if a balance remained then it would be turned over to a collection agency. I have worked very hard to maintain a good credit history. I obviously feel that I was treated unfairly. I am making payments to a different local hospital of only $25.00 per month on a bill that was much greater than the one in question. The difference is that the one that accepts $25.00 per month payments is located in Tennessee. The one I am inquiring about is in Georgia. So I paid regular monthly payments to this hospital of around $36.00 per month for several months. I called today to pay $36.00 and I was informed that my account was delinquent for about $43.00. I asked how and was told that I had agreed to pay $46.00 per month but I had only paid that amount the first time I called them. I explained what I was originally told by the account specialist at the hospital. I was informed that if I only paid #36.00 this month that my account would still be turned over to collection on May 20th. I explained that after my $36.00 payment today that would leave a balance of $36.00 for next month. I said that I would pay the rest next month because I couldn't afford to pay more right now. I have heard most of my life that as long as a person is making regular (on-time) payments of any amount to a medical provider that by law they cannot turn your account over to a collection agency. That has never been the case with most of the providers that I have dealt with. What are the Georgia laws regarding regular scheduled payments to a medical provider? Also is a supposed contractual agreement binding when made over the telephone? I wasn't informed that my conversation was being recorded. I do not know if it was recorded. I realize this may seem trivial but I would like to know if I am being treated fairly. If I'm wrong at least I'll know that I'm wrong! Thank you for any advice you may be able to offer.
