pardon request denied
I was wondering if someone out there can help me. I recently put in a pardon for my husband who was convicted and served 13-1/2 years here federally for a drug conviction, and then deported as he was not a citizen to his place of birth, Italy. I got a reply back from the Pardon attorney stating that the petitioner had to be a resident of the US? I am rebutting this saying the Marc Rich case where he was not a "resident" who fled to Switzerland as a fugitive after he was convicted of tax evasion. I called washington and stated my case, and they said it was a Homeland Security (INS) problem, nothing to do with pardon attorney. I stated the US convicted him, and before I can go to INS to request permission for re-entry he would have to either get a pardon or clemency. Do I have any legal basis to stand on at this point with the above mentioned case that I am planning to appeal with??
