FDA has made sure for years that pharmaceutical companies do not influence physicians prescribing habits. Thus PHARMA Guidlines were formed. However, much influence and many bad policies are forced by Insurance Companies and they influence physicians writing habits regarding what patients can and cannot receive as far as product is concerned. In one case a pt who is a shift worker was forced to participate in a sleep study before they would approve long term use of a sleep aid. The FP clearly had justification but was not allowed to write a script till patient participated in a sleep study. This policy was put in place based on a reccommendation from a sleep specialist whose company is considering merging with a local hospital who, in fact, owns this Insurance company. Some physicians are receiving over 50K to prescribe generics even if a branded product may work more effectively or medical studies show relevance for safety and efficacy over another brand in its class.

Is there a case here to protect consumers or are they just victim to health insurance companies across the nation?

Consumer would be the best place for this unless there is a medical injury, then it would go in medical malpractice. I can understand that this is frustrating.
