Angry Newbie needs some ebay advise

Hello All,

Would appreciate some advise here, As a user of eBay with a 100% rating, I made a purchase August 8th 2011 on a high value item and won. So far so good. As a good team player, I pay right away, ie funds go into paypal escrow in good faith etc. Anyways my seller created a shipping label the next day an produced a tracking No. so far so good...well days went by and by with no shipping activity on the tracking no...so emails get sent with out much resolve. When the ship arrival date came and went, I was pretty frustrated..still no shipping action on the tracking no. well of course ebay recommendes I start a claim, and that I did. still not getting much resolve and even telling the seller he might face a derating of his score..

For the most part I bid well and won. (considered high value by ebay) I sense though, the seller has balked
at the deal as his email statement that he just "wasn't going to ship it" end of story..

I do not want a refund, I do not want to listen to ebays song and dance about buyer protection an that
failed recouse that lets the seller off the hook..I want and need that item and have waited close to 4 years for it to be on ebay. what legal options do I have outside of ebay? Will ebay go after him legally after escalation?
