Default new with questions!!!

Hi ya all, I am new and am trying to find out answers or a way to help a dear friend of mine. i posted on someone else's thread that i could not find out how to post a new thread and i still do not know now how i got here so any information on how to find any reply to this would be great!!!

anyhow- some background-he is from missouri he has been divorced for 9 years and has paid a hefty child support for one child. private school etc. he has never minded paying and has always paid xtra for anything else his son needed.

his ex had one job at the time of divorce and now has two. his son turned 18 last year and graduated from high school. he is now attending college and that is where the questions come in

his son is away at college got a grant for the majority of it she had him take out two student loans for 6000.00 and there is a balance of 8000.00

his child support payments are still being deposited into her checking account and being used to pay her bills as she says he put her through so much in the last 9 years she needs it---can his child support payments go directly to his son?

of the 8000.00 that is left to pay she believes he is solely responsible for that amount on top of the 700.00 he already pays for child support- a month-doesnt she have any responsiblity for his college education?

is there a way that he can get the child support modified- number one to be less--he makes less than he did when the support was ordered? does he need to hire an attorney to have this done? would his child support be less since his son is no longer living at home---and could it be split to be part child support and part for his college education?

by the way there was no court order as far as his sons college education

he does not have the money to hire an attorney but is devasted that his son is not recieving the child support for his expenses so he does not have to work or to be put towards his education. he was devasted when he found out she made him take out two loans so she would not have to make a contribution to his college education.

this is someone who has and will do anything for his son. it is sick that she is taking his child support and he is not even living with her and she gives him no support

any answers would be greatly appreciated

If the child is over 18 and there was no agreement for support through college, he can file to terminate the child support and then he can give his son whatever he wants. He can file himself, but I would suggest that he at least speak with an attorney first. thanks for the reply, i havent browsed that area yet however, he was under the understanding that even if there was no wording in the divorce in reference to college that due to thier laws he had to pay no matter what if his son continued on to college. im seriously, thinking of paying for him to get an attorney any idea's how much it would be to get this amended?

Well, every state is different. Probably best for him to at least speak with an attorney.
