Default need info..getting full custody

hi my name is tiffany. i am trying to get full custody of my 2 year old son..
i dont know were to begin. Me and his father broke up when my son was about 4months old. His father is currently and has been in jail at Halawa prison. He has never supported my son.
i am currently married to someone else, and have a child on the way, my husband really wants to adopt my son.
i also want to change my son last name to either my married last name or my birth last name because currently he has his fathers last name.

if there is someone who could help me please reply.. i live in hawaii and me and my husband is talking about moving to the mainland and i want to clear this up before that..

Is he the child's LEGAL father? Does his name appear on the birth certificate?

The process will be for you and your husband to file for adoption. As part of that process, the father mustl be notified. He can either bless it and willingly give up parental rights, making things much easier, or he can fight it and continue to exercise parental status, making the process harder and longer before a court would terminate his rights against his wishes. It'll really boil down to how dad feels about the whole thing.

If dad is willing to play ball with you, it's not a terribly complicated process, it just takes time for the various steps to work their way throught the system. If dad fights it, you'll need a good attorney working for your interests.

How long have you been married BTW?
