What are my rights vs. town/neighbors rights?
In August of 2004 my towns Board of Health approved my septic/well plans. I then hired my contractor to start working and I am having a modular home being built with a scheduled finish date of March 2005. The drilling of the well was scheduled for last week but was stopped because of 2 reasons. (1)the town claims that they overlooked the location of the well (it is supposed to be 25ft from the street and its not). (2) an abutter claims that my septic system is going to affect his drinking water (even though state law is that my septic is to be 100ft from his well and it is!!). So the neighbor is petitioning the town for a meeting so he can stop me from building if they say no he threatened them with a law suit. The town agreed as said above and now my modular home is going to be built with no where to go Can I hold the town or the neighbor liable for any costs accrued for storage fees? Also as a side note the neighbor WAS notified of the meeting in August of 2004 which he could've voiced any concerns at the time but he chose not to attend. How the can the town grant him thid meeting when he could've already went its his own fault and I'm being punished for it.
