Unhappy My Dad's belongings

My dad died 7mo ago. Since that time my step-mother of 22 yrs I have discovered her true self-I have been shown signs of anti-social proclivities (sociopathic). I am totally shocked that someone could be that way but as I look back over the years it is becoming clearer. Deb (the step) has 2 children-Kim and Joe (not my father's biological kids). I have a sister Carrie (Dad's biological child). His will was never filed in any legal way but it was drawn up by a lawyer. I am executor with Joe. I still have not seen the will, I was kind of afraid to ask her, and I didn't realize the depth of her deception. My (along with my sister's)only interest is in obtaining our portion of his ashes, some of his belongings, and my grandmother's belongings. I do not have any interest in any of his monetary assets as I know he wanted her to have them, he was very snowed! I am assuming I can contact his lawyer to get a copy of his will? Can we legally get my grandmother's things? Or do I need to see what the will says since they had passed on to my dad?

Who appointed you Executor of the Estate? When did your Dad pass??

He informed all of us-Deb, Carrie, Kim, Joe, and myself that Joe and I were executors. Supposedly Joe and I are executors per Deb's will also, although I don't care to stay involved with her unless it means obtaining my dad's things. He died June 3rd.

I'm sorry to hear about your dad's passing and that this has been such a frustrating situation for you. If you know the contact information for the lawyer who prepared the will for your dad, I suggest you contact him/her immediately. Exectors should be contacted immediately, and it has been several months. I would send a written request for information about the will and whether or not the heirs have been properly notified.

You can not obtain your grandmother's property unless items of hers were left to you specifically. If they were left to your dad, they would be part of his estate... in which case the will determines what happens to them.

If you believe there may be wrongdoing going on, you can certainly speak to an attorney regarding what legal options or rememdies you may have. You can find one through the locator service on LawInfo's home page at: http://www.lawinfo.com/. Some do offer free consutlations. Good luck.
