My father in-law was injured nearly five years ago on the job. During the settlement process, his attorney told him that they could petition to have MSA funds released to him with no strings attached if he does not use any of the money in the Medicare set aside account after a few years had passed. Is this correct? He has not used any of the money in the MSA.
A few facts of the case - he was given a 38% PPI rating and is unable to work. He is drawing Social Security disability benefits.
