Default Motions and Roberts Rules of Order

Scenerio;

Under "New Business" a member wants the support of our Corporation to support their nomination for 1st Vice President of an association that our Corporation belongs to. A motion was then made on the floor to support him followed by a second. Adiscussion then followed with a vote. The Vice President allowed two absentee votes. The vote was secret ballot and counted. The vote for the motion was 17 Yes and 18 No. The membership got into another discussion about the matter and questions were also raised about absentee votes. Another member hearing all of the arguing asked for the motion to be tabled and requested a special membership meeting.

Questions;

1) Can you accept absentee votes for a motion that wasnt made yet and was not present for?

2) Can you table a motion or item after it was voted on?

3) Since motion count was messed up by allowing the absentee votes, can you just deduct the two votes?

4) If you do the above would the vote be 17-16?

5) Would the above motion require a 2/3 vote or majority?

6) If motion passed can it be brought up again and voted on again after just passing?

Thanks

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
