Default Mortgage Fraud

Hello out there. Thisa is my first posting and I have a scenario I need help with. I'm dealing with a builder that has found me in default on two of my purchase contracts based on inaccurate information.

I have thoroughly documented my complaints against them with several gov't agencies. However, I am currently disputing the amount that they claim I'm responsible for (which however they will not move forward legally becuase they already know the position they're in). However, they back-dated documents and have conspired with an outside lender to defraud me of my good faith deposits. The outside lender provided them with back-dated pre-approvals in order to help the builder have a reason to find me in default. Neither of them dare send me a copy of the document that they are using to find me in default because they know I can prove that incorrect.

The builder is required to go to arbitration over any disputes. They have refused to provide me with the information to begin the arbitration process. I am also dealing with everyone from the president of the Indiana division on down and have named about 12 people in my complaints.

What thoughts come to mind regarding this position I'm in? Thanks.

I am sorry that people have not responded to your posts. I do try to respond to all of them. I really have no way of getting other members to reply. As for your issue, if they are to be subject to arbitration, it should be in the contract that you have with them as to where it should occur and such. This may not be something that you want to hear, but you may want to speak with an attorney to discuss your options. You can locate one through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/. Some do offer free consultations.
