Question Mistrust of Executor

My father died 11-15-07. My sister was named the executor of his will. My brother and I feel that she is doing something wrong or illegal with money and property. She did give some of Dad's property away while he was still alive. She has had all his mail forwarded to her. This includes bank statements ect. She left for Florida in mid-December. My brother went to see about probabte court. That was taken care of on 12-13-2007. She never told us that. She is stating that she has a piece of paper that I signed stating that I received the $25,000 Dad wanted each of us to have. I never received that money. My brother fully admits that he received his. My father told my brother that he could have his van. She wanted him tp pay for it until we told her that we do have copies of the will. She is lying about money in Dad's account. Telling us she has paid for this bill or that bill. Never shown us proof. She is very concerned that my brother and I are questioning people about Dad's bills and estate. She comes and goes in town and never tells us she has been here. I feel like she is doing something illegal. but I don't know what our next step should be. We would both love to see Dad's bank record. Is this possible for us to do? ANy help would be greatly appreciated.

I suggest you speak to an attorney to determine what legal options you may have against your sister regarding the handling of your father's estate. You may be able to file something with the court to enforce the provisions of the will. You can find an attorney through the locator service on LawInfo's home page at: http://www.lawinfo.com/.
