I filed suit against a Michigan based Company for a Breach of verbal Contract. They promised me a pay raise if I took a job in another Dept because they couldn't fill the position, but then came up with one excuse after another for not giving me the raise. The suit was filed in the Third Judicial Circuit.
Without my knowledge and without my lawyer taking any depositions , the case was reviewed by a Michigan Case Evaluation Panel as per MCR 2.403. The panel awarded me an insignificant award and my evaluation of the information submitted to the panel by my attorney convinces me he is incompetent. As per Michigan tort law I now must decide to accept the low award amount or take it to trial, knowing that if I lose the case I must also pay the attorney fees for this big Automotive supplier. Discussions with another attorney indicates that the case has proceeded too far too in circuit court to do much with it.
My question is:
Is it possible to just drop my suit complaint in Circuit Court(try and start all over with a better lawyer) and reopen it again on similar charges but in District Court, or possibly Federal court(The company is owned by a Japan based company)
