medical malpratice or not
I was bit on the forearm by a spider. I didnt immediately goto the dr because it just made a little bump with 2 red dots in it like a mosquito bite with 2 holes. the next day i started feeling bad i thought i had the flu all my joints ached i had a fever and a bad headache. Then the sweeling started to get worse on my arm the place got bigger so me and the misses deciced to poke a hole in it and thinking it had fluid under release some of the pressure. it didnt that night i had leg cramps a severe headache and couldnt sleep. i went to my reg dr he said i needed to goto the hospital because the bite had set up infection and was causing some cellulittis. I went to the emergency room they cut it about the size of a quarter to drain and dug around in the hole trying to clean it out. they then packed it with gauze and put me in a room and started giving me antibiotics. The next day my arm was worse a dr/surgeon came in the room told me i had staph infection and they were gonna have to cut on my arm to release the infection. They made a 3 1/2 inch long cut in my arm that was about 2 inches wide and they didnt even shave the area they cut on it had hair laying in the open wound. The next day my arm was even worse it was swelled up from the top of my shoulder to my fingers i couldnt even see my knuckles and my fever was getting higher. The same dr/surgeon can back in later that evening and told me he was gonna have to to 4 cut long gashes in my arm from my wrist to past my elbow to let the infection out. i told him no way i wanted to go somewhere else. after 3 days there my arm and fever was worse than we i came. So i decided to goto UAB and told them i was going. They came to my room after the fact wanting to do a cat scan to look at the infection to see where it was at, all this after he already cut and knew i was leaving. long story short i went to uab they did a blood test 20 mins they said i had strep infection not staph they also said my potassium was bottomed out. i told them where id been and what was goin on they said they wouldve been no way they wouldve cut on me with my potassium that low and they wouldve cut me only as a last resort and after a positive cat scan for infection in the deep tissue or joint of my arm. They gave me penicilin and diffferent antibiotics to fight the infection. The next day my arm was better and the next it was even better. 4 days after being in UAB i went home with the possibility of having to have a skin graph at a later date. 2 months later my arm is healed but i do have a horrible scar. My question is If the first DR/surgeon would have got a realiable test result and then gave me the proper antibiotics and came to see if the antibiotics they were giving me was working or not i wouldnt have spent 7 days in 2 hospitals. the first is about 20,000 and the second is over 40,000 and i do have ins, is there any legal recourse sorry this is so long but it is what it is. thanks for your help and advice

Wow, I can undersstand this has been quite a frustrating situation for you. Now I'm going to be totally careful about possible spider bites!!! At any rate, medical malpractice claims can be tricky - the reason being that malpractice is generally considered to be care that is below the regular, reasonable, standard of care to be provided by other, similar doctors. I do suggest you try to speak to an attorney regarding whether or not you have a potential claim. The substance of what you've posted here sounds reasonable enough to at least investigate your legal options. Some, if not most, plaintiff's personal injury attorneys do offer free consultations and may even forgo payment on a contingency basis (you pay out of any settlment you recieve). You can talk to an attorney about the payment options as well.

More on negligence side
i was told earlier this week this would probably be more on a negligence type problem, dont know if thats in with mal practice or not and they also told me make sure i hold onto my pics they could be valuable evidence. Anyone with any advice would be appreciated thanks

Medical malpractice is basically the common term for professional negligence. I suggest you speak to an attorney regarding your potential claims as soon as possible as there may be certain things to do quickly in order to best position your claim. Injuries fade, and the evidence is the injury.

You may have a claim here. Going by what you have stated, the standard of care here seems to have been lacking. Hurry and contact a medical malpractice attorney. You don't need to wait on this one.

I think you definitely have a case with this one. You've clearly been the subject of medical malpractice, which by and large is professional negligence and should not be tolerated.

You should seek the help of a Malpractice Attorney as soon as possible. Often there will be a statued of limitations on these kinds of things. Good Luck!

Different spiders have different dispositions. Grass spiders are very skittish while wolf spiders are a lot more docile. Also, 99% of all spider bites do not require medical attention, and only a very few spiders *can* give bites that require medical attention. I, personally, am a bit skeptical on all those nasty brown recluse bite pictures, because I know that many other ailments can cause such wounds, and even doctors get confused.

Medical Malpractice Is a Proffessional Negligence
Medical malpractice is professional negligence by act or omission by a health care provider in which care provided deviates from accepted standards of practice in the medical community and causes injury or death to the patient. Your case definitely fits here. to help you because medical malpractice is somehow tricky and you have to take note of this clause that says, ithout damages (losses which may be pecuniary or emotional), there is no basis for a claim, regardless of whether the medical provider was negligent. Likewise, damages can occur without negligence, for example, when someone dies from a fatal disease.
