Default Medical Malpractice Dentist Sanctioned

My daughter had went to a Dentist that practiced Orthodonia but was not a specialist in Orthodonia and there were numerous problems and his treatment never corrected her teeth and actually damaged them. I was told that Michigan law prevents me from suing the Dentist for damages. I did file a complaint with the Michigan Dept of Consumer Industries (Medical department). They did an investigation and found the dentist negligent on several accounts in my daughters treatment and they gave him some type of sanction or discipline on his liscene. Would this information mean I should try again through a lawyer or small claims court to get him to pay me back for his services? He advertised one lum price for all orthodonia services and I paid it all and my daughter's teeth were damaged he made her lip droop and I had to go to another dentist to get her teeth fixed and finally straightened at an additional cost.

It may be wise to have your specific factual situation analyzed by an attorney in your jurisdiction. And you should have this done IMMEDIATELY so that you don't lose important rights. Default Probably is available compensation for negligence

If you can really prove that this dentist didn't meet the ordinary standard of care for other dentists, or the orthodontist he held himself out to be, your claims (if timely filed) may be compensable even in Michigan. You do need a lawyer there to evaluate that for you. Good luck
