Default Medical Malpratice Deadlines?

About 4 years ago this Nov my father went in for a heart cath. While placing the stent the DR messed poked a hole in my Dad's aorta. It has come to light by a reliable source recently that my father coded three times and was pushed to the side to die. Eventually he was pushed up to CVICU and around 1-2 the next morning he did have to have open heart surgery to repair the mistake. He required 14 pints of blood and now is in congestive heart failure. Thanks to one very good DR and the Lord a miracle my Father was a miracle and was saved. It is a miracle we still have him. We were never told the details. In fact the attending physician to this day has not faced us. We have switched hospitals and DRs. We went to numerous lawyers trying to get help so justice would be done. We told them over and over a name that they could subpeona and once put on the stand this person would talk. Now after all this time when we find out just how incompetent this DR truly was is there nothing we can do? We have lived through a nightmare during this ordeal. No one else should ever have to worry about this happening to someone they love. A family deserves to know the truth! We are so hurt and angry. I find it so hard to believe that when you trust a DR and hospital with your loved one that this could take place and you never even be told.

I understand that this is a stressful situation for you and your family. I am not sure if you are asking a question or just need some place to vent. Either is fine, but I would like to direct you to some help if that is what you are looking for.

Do you think there is still something that could be done? We were told you have under two years to get a case.

There are statutes of limitations in every state that bars the filing of a lawsuit after a specified amount of time. The time period is different from state to state and depending on the type of case. You need to speak with an attorney in your area that deals with these types of cases. He or she can then explain what the time period is and what your legal options are. You can locate one through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/.
