Mary Jane found w/o a warent... need help
A (ex) friend got busted and he told the police that he got the marijuana from my house. The police came to my home and knocked. My boyfriend answered the door and two police officers asked him if they could ask a few questions. He told them "hang on" and he lef tthem a t the door. The police took it upon themselves to enter my property without being asked inside. Immediatly after entering they looed down and found stems and seeds. THey told me they then had probable cause and could search my house if I let them but if I did not let them they could detain all of us and go and get a warrent. I let them because it seemed one option was no better than the other. They searched and found approx 3 grams of marijuana and seeds and stems a scale and baggies. All of which is not used for distribution. I told them it was my stuff and they ticketed my whole house for "usage". My question is: Under current law does a police officer have to be welcomed into a home before doing so on his/her own accord and if so is what they did considered "searching" without a warrent? If it falls under the "plain view" law is it still legal for them to just walk into my house uninvited when they saw nothing until they had entered? If so what can I do about it? I have court on the first. Also I am on disability for severe mental disorders and could it be proven possibly that I was not aware of my rights when they told me I had to either let them search now or they would get a warrent and detain everyone while they went to get one? PLease help me.
