Question Looking for some help.

All,

About 8 years ago I bought a car from a company called Deals on Wheels. The car cost me about 8,000 Dollars and lasted for two months. After much hastle and getting shafted from the company (with very little legal recourse at the time) I decided to go park the car and calld them and informed them where it was. Told them they could have it and the debt, and that I had no intention of ever paying them. I ment it then and I still do.

The debt was never settled and there were no judgements made, the debt eventually dropped of my credit report and no longer shows up, however every single month they show up as an Inquery on my Credit Report. They appear in the normal inquiries, just like other people to whom I've applied for credit. I have two questions

1. What is the statute of limitations for such a debt in the State of Delaware ?

2. Is it legal for them to keep inquiring into my credit since, at this stage in the game, it is likely that they have no permissable purpose (if there is a SoL that has passed) ?

As you know, every state has different laws regarding situations like this. You may want to check out Delaware's state website to see if you can find out if there is a statute of limitations and how long. Depending on what you find out, you may want to speak to an attorney regarding their inquiries into your credit. If they are no longer are reporting on you credit report then I wouldn't worry about it. The statue of limitation is 7 years from date they first reported the debt as bad. However, as soon as the debt was deleted off your credit report depending on your state laws then they no longer can legally pursue the debt any longer. If they are still obtaining your credit information without your permission, that is affecting your credit score, then ask your credit bureau to put your credit report on fraud alert. Which will block unauthorized companies from viewing your credit report.
