Legal malpractice or something else???
Hello! We are in need of advice regarding possible legal malpractice that happened with the "other" attorney not ours. This includes the Banks attorney filing a 'certificate of foreclosure' 2 weeks before the COURT ORDERED sale date of our home. As a result we lost a sale in February as well as any time to refinance to rescue our home. We notified all parties regarding the final law day and they apparently were not paying attention. My opinion is that because we are just 'regular' people they more then likely figured we were not going to defend ourselves. What can we do aside from a 'motion to reopen' which the judge refused to grant anyway with no explanation... We have been told that no one can file against the court order but they did and we are losing our home this is a large amount of money...we have spent over a year trying to save our home and at the time the Banks attorneys file the certificate we had a sale pending.
