Default Landlord accusations

Ok I'll try to make a long story short...my 2 roommates and I moved out of our 3 bedroom apartment on Sunday May 14th (but my landlord refuses to work on Sundays). We left our keys and parking passes on the kitchen counter as instructed. The landlord came and inspected the apartment 3 days later and found everything in order. He left and came back the next day to find the refrigerator and stackable washer/dryer had been stolen. He's now pulling the amount of those appliances out of our deposit claiming we must have made a copy of one of our keys and made an arrangement with someone to come in and steal them though none of us made a copy of a key or were even in the city the night it happened! Can he do this?

Default appliances

first of all he has to give you notice (within 45 days in writing) of any claims to the deposit. If you are certain he is responsible I would take him to small claims for the deposit so he will have to prove what happened to them
