Labor and Employment
My son answered an employment ad in our local newspaper for construction of homes. It was a private ad from an individual who was a subcontractor for Ferring Homes. He applied for the job and was picked from other applicants. He had two applications and was hired by his first application which was Encompass Co. Meanwhile the private contractor called and said he would hire him for $12 /per hour as to the $10/per hour job that he was hired @ Encompass. He excepted the subcontractor's offer and went to work for him.The 1st day at the job site went alright, but the following day,the subcontractor had him ride with him to the country site where work was being done on a house. Now reminding you, he had no escape from his boss, as he couldn't walk miles back to town. His boss became irate during the course of the day and proceeded to berate and belittle him, at one pont breaking him down to tears. There was harrasing name calling such a"fairy" and Chicco Rodrigues[?} and and yelling at him.My son managed to keep his compusure and finish the day with this beligerent person. He put in 2 eight hour days for the bossman and didn't return to work for him the following day.Now this subcontractor is refusing him due wages and claims his lawyer was contacted and our son owes him for newspaper ad and for having to replace him. He also called our son on his cell and verbally threatened him.Our son was fresh out of Kirkwood college and this boss hired him with the knowledge of that. Our son hired immediately the following day with Encompass as they still needed someone.Thank goodness for that. The Iowa Labor Board has recieved forms as to this formal complaint. Does this contractor have to be compliant by acknowledging receipt of this complaint or can he just throw the notice away and ignore it without any further ado? I believe he should have to answer for treating my son that way and pay him for his work. And also to prevent this man from doing this to someone else unsuspecting.Thank you for any replies I may recieve.
