Default kidnapping?

I don't think there is a kidnapping unless one parent has some sort of a temparary custody agreement or a divorce or legal separation would give one parent or the other physical custody of the child. There is no such thing as 'joint custody' so someone has to have physical custody. If there are no agreements that would be the person who has the child currently.

I could be wrong but as i recall that's correct in the state i live in.

This poster's question was posted one year ago, it doesn't appear that the OP has been back, so it's doubtful that they will see your reply.

BTW- yes, there can be a thing of true "joint custody" where neither parent has exclusive physical custody.
