Hi My fiance and I have applied for a K1 I overstayed my B2 by 348 daysthe judge granted Voluntary departureI left on time. I have been back in Australia now 1yr3months. My question isis there a banand can this affect the decision of the K1? Has anyone received K1 after Voluntary Departure? Would we need to apply for a waiver? If so when? I have no alien #when I checked 1800#does this mean I am not in system? Can I also apply for another B2to visit while we are waiting on K1? Do we need to hire an attorney at this stage?as we also have RFE from USCISasking for proof of relationship in past 2 yearscan't they see from my overstaythat we were together? We also just purchased a housenow have a mortgageis it in our best intrest to let USCIS know this? Thank you. Ange.
