Default Identity theft

I was the victim of Identity Theft. The girl that stole my identity has been arrested. I have police reports and detectives I helped in finding her. I found out through this investigation that she stole my identity from my doctors office she worked for. She has no money and I was wondering if I could sue the doctors office? I have been dealing with this theft for over 1 year and have put in a lot of time and effort into rebuilding my credit. I am under a great deal of stress from this and my life has been violated. I am looking for advice and a lawyer that might be able to help me.

Can you prove that the doctor's office had knowledge, or should have had knowledge, that she was stealing the information, and that they then failed to act? Are you familiar enough with their record keeping procedures, software, and protocols to prove to a jury that they are somehow responsible? You can always at least consult an attorney in your state who specializes in these types of cases, and see if the attorney has ideas about exactly what types of proof might be available, how to obtain it, and how to present it in court.

(Realizing that of course the defense attorney for the doctor's office is going to clearly tell the jury that the responsible party has already been arrested, and that you're now only suiing the doctor's office because the ACTUAL criminal doesn't have any money.)

I have to agree with aardvarc on this one. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available.
