Homeless of Jail by Court Order
Homeless or Jail by Court Order The divorce says sell the house and divide the proceeds. I have to retain the house to avoid capital gains taxes that would bankrupt me and leave me homeless. I am physically disabled and have 2 small children. I have through my buyer representative (real estate agent) submitted offers to the real estate agent I was court ordered to hire as the seller. My ex-husband has refused to acknowledge any of the offers. I have even put in a BLANK offer where my ex-husband can write in what he wants. Today the day before Thanksgiving without my knowledge a judge signed a court order stating that I must sign a sales contract selling the home to another person (my ex is not accepting my offers) by Monday or present myself Tuesday morning to start a jail sentence. The only reason I know of this court order is because my attorney's office faxed it to me after 5 pm but the attorney has not spoken to me. The court order states he was present but did not sign. I spoke with the attorney yesterday and I am sure he was as surprised by this court order as much as I was. I told the judge just 3 weeks ago I was offering to buy the house. I have been telling the court since March of 2005 that I wanted to retain the house. There is no legal reason why I can not retain the house. Any suggestions? Dee (210) 662-2714
