Help with Lease
In my daughter's lease there is a stipulation that she cannot sublease unless that person is added to the lease. However we had a situation that I would like to run past you to see if it's worth taking to Small Claims Court. In October 2004 my daughter moved into her own apartment with my husband as a grantor. I am not on the lease. In March 2005 she tried to commit suicide and was entered into a partial hospitalization program and she was not allowed to live at her apartment alone so she was staying with us her dad and I. She had a friend who told Ashley that she would stay with her so Ashley went to her doctor and introduced her friend. The doctor talked with them and decided that it would be ok for Ashley to go back to her apartment with Heather being there with her. While she was helping Ashley get stabilized they decided to become roommates. Ashley told Heather that she needed to fill out paperwork to get Heather on the lease. Ashley went so far as to go to the leasing office to pick up the papers and gave them to Heather to fill out. There was a verbal agreement that beginning April 1 Heather would pay Ashley $400 a month but she wouldn't get a key to the apartment until she was on the lease. April came and Heather couldn't pay anything. May came and went and still Heather didn't pay anything. So in May Heather told Ashley that she would pay June's rent because she hadn't contributed the last couple of days. Ashley was afraid that she was going to get screwed so she called me to come up and help her talk to Heather to make sure that she was going to pay the rent. Heather promised me that she would have the rent to the rental office before June 10th so there wouldn't be any late charges. By the 10th all of her things as well as her boyfriend's things were gone. We suspect they make an unauthorized copy of Ashley's key and let themselves in and out when Ashley was at work. Hence...no money. I forwarded $950 to my daughter so she could take care of June's rent and the late fee. Then we had the locks changed which was another $51 dollars plus Mike and Heather had long distance calls and personal loans from my daughter that they didn't pay. The problem is that because Heather never turned in the paperwork to get added to the lease Ashley nor my husband can go after the money. I need a way to go after her because I am not on the lease. Can you please help me to go at this case in honesty but with the chance of winning it. We are a military family and we could sure use our $950 back. The initial reason for Heather staying with Ashley was medically necessitated because she couldn't be by herself. Ashley did the right thing trying to get Heather to sign the paperwork and the more she pressed the issue the angrier Heather got until she moved out. PLEASE HELP!
