Default Health Insurace Refusal

My husbands company will not give him health insurance coverage even though every other employee is offered it. He works full-time just like everyone else. For the first few years that he worked there we refused the insurance because I had coverage through my employer. Then I was layed off from my job and lost the insurance for the family. He requested to be enrolled and has been told that if he gets insurance "the company will be forced to lay somone off" (implying that he will be let go). Open enrollment has passed 2 times since I have lost my job and he has been told that he cannot receive the coverage. In the past (while I had coverage) he was required to fill out a form to refuse the coverage during yearly open enrollmen and had to sign it. Since requesting coverage he has not been given any forms to sign and is assuming that someone in the office has been filling out and signing a refusal form on his behalf. Does he have any kind of case against them? And forgot to mention that he is the only black employee in the company. Not sure if that makes a difference
