I filed a motion for Court Order Modification (custody) on 8/15/2011. To date, I have not received a Declarative Response from the Respondent (my ex husband).

Based on the 9 day filing issue for a response, it should have been filed with the Court yesterday and I should receive a copy of the Response today, correct? My hearing date is 9/19/2011.

Does the Respondent have to file a response?

What if he does not? If he does not, do I have the opportunity to further file additional papers related to this issue?

If he does not file a response 1) at all or 2) in time, can I ask for a default setting?
