Red face hard battle?

my ex and i split up when our daughter was 3, the fight in court was all about him wanting me to move back to idaho from oregon, i was less than 6 miles from the previous residence but he had a warrant for his arrest on him in oregon so you get it...we met with a mediator discussed things i said no i wont move you take care of your warrant...the day before court he calls and says im not going to jail or paying child support i said talk to your attorney not me...then he relinquished his parental rights and i was granted sole legal and physical custody with no visitation or child support obligations on his part...my daughter is 8 now and he is taking me to court for visitation...i want to terminate his rights so my husband who has already adopted my son can adopt my daughter too...how hard of a battle is this going to be? there is no way i would send my girl to him for any amount of time and i am freaking out! has anybody had the other parents rights terminated???

I can certainly understand this is a frustrating situation for you. I'm a little confused... not sure how he can take you to court for visitation if he has relinquished his parental rights. Do you mean the court terminated his parental rights (or approved the relinquishment)...or do you mean he gave up a right to custody? Does he pay any child support?

I do suggest you contact an attorney to determine your legal options regarding the termination of parental rights and concurrent step-parent adoption. It is sometimes granted by the courts, particularly if the biological parent consents to the relinquishment/adoption - but from your post it doesn't sound like your ex would consent?
