Default Getting the IRS to pay up

To make this short as possible I will not give the full story. In 2003 my wife was forced to file her IRS taxes as C- Corp (IRS lost Sub Chapter S tax ID) and pay over $4,000 in taxes vs $67 under the S -Corp. We have been fighting this ever since. We found out last year while I was talking to a IRS representative the following she told me " I should not be telling you this but the IRS has had your S- Corp tax ID all along" They have decided to keep this information from my wife. Two weeks later we received a letter from the IRS admitting the mistake, so we called and asked what we needed to do and they told us. Six weeks later we received a letter saying a tax lien was going to be placed against us. I contacted my Congressmen and asked him to find one person within the IRS to work on this situations. We received another letter six weeks later saying the matter was being researched. Finally in Mid May my wife received a check for the full amount plus interest. The new problem, My wife sold her business in 2004 and she filed her final income tax return. The check my wife received was made out to her old business and the IRS told my wife to mark VOID on the check send it back with documents proving she was the owner, and a new check would be cut. We just received a letter saying that the IRS will have to research this matter further before cutting a check. So my question is what is my Rights? I can we get the IRS to pay the money they owe us?

I can understand that this is a frustrating situation. I do hope you have all the names and id numbers of the IRS employees that you spoke with. You may want to get a letter together with all of this information and send it to them certified return receipt mail. If you can't get anything done that way, you may want to speak with an attorney that has experience dealing with the IRS.
