formaldehyde releasers in cosmetics causing skin disease?

If a consumer purchases a cosmetic and it contains formaldehyde or formaldehyde releasers in it (which is proven to cause cancer) and the consumer develops a skin disease from the chemical-does the consumer legally have a case against the Cosmetics company? The FDA nor does the government regulate the cosmetics companies-over 1000 chemicals inclluding formaldehyde has been banned in Europe- The United States has only banned 8 since 1938 and only 20 percent of cosmetics are inspected by the cosmetics companies safety team experts. Who is protecting the consumer? Now consumer has skin disease FDA has been contacted-they have sent report to manufacturers-now manufacturers are contacting consumer-should legal action be taken now that damages are not repairable?
