Default foreclosure / family / the law

Please help me - like millions of Americans,my husband and i lost our home to foreclosure in 2007 after owning the home for 13 years. We have 4 children 2 married - 1 is a teacher in bergen county - our youngest is away and in his last year of college, he is the one i am writing about. He happens to be a "junior" (has his father's name + Jr.) Today he receive a letter from one of these companies who tries to get you to allow them to recoup money after a sheriff's sale (for a percentage). because we did not reply they found his name and informed him that we lost our home to foreclosure (a fact my son did not know) and please help them to locate us. My heart is broken - after all the term oil and heartache we endured my husband and myself prided ourselves on the fact that we got though it without having to let our children know anything. My son called me in a panic - i was dumbstruck and had to tell him the truth. IS IT LEGAL TO DO THIS TO PEOPLE? WHAT RECOURSE DO PEOPLE HAVE? i am terrified of who else they might have gotten in touch with - there are many family members with the same last name that do not know!!! Please let me know what i can do. Thank You

I can definitely understand how frustrating this must all be for you. Most county records show foreclosures as public record, so I'm not sure how much privacy you can expect. You can certainly try to speak to an attorney if you feel a company has published your information to family members, friends, etc., unfairly. You can find one through the locator service on LawInfo's home page at: http://www.lawinfo.com/.
