Default Fighting against thrash problem

I am living on the first floor of a high-rise building, facing the backyard. That is the condo we bought it, and it's in a very good area. Unexpectedly, people on the high floor above our apartment are keeping on throwing cigarette butts and matches down everyday. The cigarette butts and matches are accumulating very quickly. We talked with condo board because that is the behavior violates the condo law. But the board has never done anything to try to stop it. They even didn't write a letter to the tenants in the building to inform them that throwing thrash in the common area is a violation of the board law. We have to fight alone, post signs again and again to ask people not throwing thrash down, but no improvement. Since it's a high rise building, it's very difficult to catch the person, even some one seeing the person doing that, he can still easily denied, unless catching him on the spot. We also brought up that thrash problem to the building annual meeting, but the board said they had no good idea to resolve the problem. Then we requested to clean backyard to keep it clean everyday.-The building doesn't clean backyard. After the meeting, the backyard was cleaned once. Then they didn't clean backyard anymore.

The fighting has already last two years, and seems no end. Can we sue the board because they do nothing to stop people violating the condo law and making us living in a dirty place? Can we stop paying common charge till the building maintains in a clean condition? Does anyone have any good idea to help us fighting for that and let people stopping throwing thrash down? We are really exhausted, and really need help.

I can understand that this is a stressful and frustrating situation for you. I would suggest that you speak with an attorney in your area that has experience in this area of law since all states have different laws regarding this.
