Default Fight, body injury

Question, my vatios was in an altercation @ Mcdonalds in Oakwood... It started inside and the witness's told police that he did not start the altercation. He lost part of his vision and has lost his job. One of the aggressors has been put on probation and the one who hit him with her car was not charged because the OPD said she was underage! Can you believe that? Well what can he do does he have a case for legal action because he really needs to be vindicated, if not who knows? Is McDonalds partially @ fault?

I am not sure how McDonald's would be liable for this unless they knew something was going to happen and did nothing to stop it.
