Default Father wants to file for Primary custody

My ex and I share joint custody and right now she lives primary with her mother on other side of town. We are having issues with parenting time and are not speaking with each other. She has put in temp. orders for me not to see my daughter stating she fears for her daughters safety and that I might abduct her. That trial date is set for next week. I think I have been pretty nice to her mother but I am tired of being taken advantage of, She has post poned the trial for the modification since 8-9-10. Our biggest issue is transportation. But my daughter tells me all the time how she does not like living with her mom, she wants to stay with me and my wife and other children. She tells me all the time how mean they are and how they say mean things about me and my wife. My ex has even threatened my daughter that if she doesn't do well in school or behave she will not get to see me. I am not sure what chances I have. The only proof I have of verbal abuse is through my daughter, what can I do?

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html and http://resources.lawinfo.com/en/index.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
