Default Father died '93 will states: complete confidence my wife will take care of my childre

This is the first time I have ever posted on anything. In short, Father died in '93 (He was an attorney). He left everything to my step- mother. She has not helped me despite will stating: "I have complete confidence that my wife will take care of my children and my son, XXXX, in the manner we both desire. Stepmother has taken care of her son but not me and my sister (we are his children). Can we sue based upon this statement. I was so upset, confused and mad that he died at 49 that I just now asked for a copy from courthouse. Also, father was very abusive to me, my mother (his first wife) and my sister. We have hospitol records, pictures and a court order all the way from 1971 instructing him only to use his hand on me below the waist among other things. My Mom kept it from me for 36 years- just got a copy last month. I was 5 when the court issued the order due to Great Aunt's intervention. Dad tried to change but left me and sister in the cold. Due to abuse Mom moved back to France in 1980 and took sis with her after they had been divorced for 6 years. Visiting each other is very expensive. step brother has been bailed out of financial trouble. Can we do anything. She is well off now and Dad left her with Estate that would value at 250K in '93 when he passed.

You could try to contest the will or the way that she is executing his wishes, but you may run into a statute of limitations problem. I would suggest that you speak with an attorney to discuss your options. You can locate one through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/. Some do offer free consultations.

Sorry, there is nothing you can do. You might have been able to contest the will back then but it is now too late.
