My wife had an affair with my brother for two years. I found this out recently and am not sure if my youngest daughter is mine or my brother's. I am confused and hurt and would like some help on what steps I can take. My wife and I have been going to marriage counseling and have decided to work things out and remain married. Should I get a paternity test to find out if my daughter is actually mine? When I find out that the child is not mine, should I get a lawyer and force my brother to pay child support? If he pays child support, what rights does my brother have concerning my daughter?

My brother also wants to take the child away from my wife and I if we find out it is his child. Can he do that although the child is legally mine? If he agrees to pay child support, do I have to get a laywer involved? Thanks in advance!

If the child was born during marriage then the child could be considered yours unless he asks for a paternity action. If it is determined that he is the father then he would be obligated to pay child support and entitled to visitation as the court sees fit.
