False Advertisement Detrimental To My Business
I am the owner of a small business. We specialize in livestock slaughter and processing under USDA. We also have a retail meat market that specializes in meats bred, born, raised, processed, locally...completely source verified 100%. We also have our own beef cattle farm, where the majority of our beef meats in our market originate. There are no other places local to me that can offer this source verification and quality all in one peice of property. The local chain stores do not seem to like this fact.
My question is do I have any recourse against a competitor for false advertisement detrimental to my scarcity.
IGA was on our local TV station doing a cooking segment. The spokes person stated how wonderful their meats were and that they were "...all local Kentucky bred beef". She also stated that "...IGA works within a 24hr window from cutting the "cow" into pcs to the dinner table." There are many problems with here statements. My largest concern is the "...all local Kentucky bred beef". They cannot substantiate this claim. It is grossly false. I contacted all local IGA stores for source verification of the statements. Most said they did not know where the meats came from because they arrived on a big truck. One stated that the meats were "kentucky beef" but came in EXCEL boxes already cut and packaged. Well, EXCEL is a brand name owed by one of the nations largest beef packers and I can be assured that there can be no source verifcation there, nor is it local. The Packerl (who owns this brand) doesn't have any plants anywhere near Kentucky. I have contacted the TV station. I have also contacted IGA, but have gotten no response from either.
Since my business is based on locally produced and processed meats and they are now falsely representing their meats on our local TV station to represent my meats, do I have any recourse???
