Default Eviction - please help

I send a letter to my landlord explaining all the problems we where having. In the letter i stated how we where paying him half a month rent until he fixed the problems. The letter wa no certified, which was my fault. Anyway.
A couple days later, he posts a 5 day notice in 2 different spots on the house, both having my social security number in big bold numbers on the letter on the house (is this legal)?
Secondly, the guy has yet to give any receipts, including rent we have paid, nor has he or will he give a receipt for the security deposit, yet the lease agreement states before the move in date, the $1400 security deposit must be paid.
Is there anything we can do, or am i basically screwed?
Thanks for any help and or feedback.

Shouldn't you be able to go to a city or county dept to have them do a building inspection if you have a bunch of stuff wrong with the property he would have to fix? It sounds like your landlord doesn't want to fix anything that you had noted. it probably wont stop the eviction now, but would be worth a try to get someone involved. the best thing you could have done was to have had the letter certified and notarized along with a formal complaint to the proper authorities.

Default He's trying to fool you

First of all, I believe that in any state, no matter what the circumstance he has to give you at least 30 days to move out. He can try to take it to court but that kind of case will take about 30 days to be heard, and most likely the judge will give you another 30 days if you tell him you have no where to go. But if your landlord take it to court at least you will be heard by a judge.

Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to a lawyer to determine what legal options may be available. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
