Equipment Security Deposit Question
I know that I can get a free consultation from some lawyers in my area but I’d rather just hear some honest opinions on here since nobody is threatening a lawsuit or anything.
I coach a youth travel hockey team in Michigan. I was told by one of my assistant coaches that I couldn’t legally do something but I honestly disagree with him on it. He suggested I try this site for some opinions.
I collected $100.00 security deposits at the beginning of the season from each player for various equipment items the Association gave the players to use (like game jerseys, bags, and pants). This was to make sure I got it back at the end of the season and still in reasonable condition so the next season team could use it.
The season is over and all of the players have turned in their equipment. I had to turn the equipment back in to the Association so the equipment is not available for use until next season in a few months. What am I legally required to do with the security deposits from the beginning of the season? I have 90% of the players returning next season and only a few moving on to play for another team.
I just used the money to purchase some ice over the summer to build the players’ conditioning and skating skills but my assistant coach said I am legally required to return the money to the players’ families right now. I am going to give the kids leaving the team their $100 back but I don’t think I have to give the other players until they actually leave the team. Am I required to tell or even ask the players to use that money for summer ice? I think that as long as they get it back when they leave the team it is okay if I do that.
Again, what am I legally required to do? I want to make sure I do the right thing, even if I am wrong in my thinking. Where might I be able to research Security Deposit Laws in Michigan?
