encroachment not disclosed
Seller did not disclose encroachment. A neighbor drives over land that I plan to buy to access their driveway and has done so for 18 years. The land area is small and in the corner of the lot. I am trying to understand the implications of 2 options. 1. close with the encroachment 2. grant an easement to the neighbor What are issues/benefits to each option? There has been no discussion of compensation from either the seller or the neighbor. Would like to stay on good terms with neighbor but not give up my rights. Is it common to ask seller for price adjustment if I clear the encroachment with an easement.
