Unhappy employment or civil?

I am going crazy! I was called into the HR office on Monday a week ago and was suspended w/out pay and was told I needed to write my side. I was told I threatened and called someone names at the work place.
I was escorted to my desk to get my car keys and purse and escorted to my vehicle like a criminal.

A quick over view is I was trying to get a game that was made for a non profit youth league I run from a woman who worked on the same grounds as I. I did not call her from work it was from home at night and visited her home to try to pick it up.

What I sent the Hr person was the letter below along with the portion of my phone records showing when the texts were sent to what number along with a copy of my FB comments minus friend comments. The texts and FB comments were made off the clock. I was done with work.

The woman I will call Sally and my co-worker I will call Bill.

I received a phone call from Bill close to 3:20-3:25pm on 22SEP10 telling me that Sally called him to go over and pick up the Baseball bean bag game that was the League’s. I explained I was just finishing up my work and would go over to bring it home.

I met Bill in the parking lot by building I parked my truck near Sally's because the game I knew was very heavy and had a very large stand etc. One person was not lifting this up by themselves. We waited and waited and noSally. I opened the door to go inside the building and saw Sally walking down the hallway towards the door so I just went back out. I do not believe she saw me because as soon as she opened the door she looked toward me and said “oh shit” and walked backed in.

Bill and I continued to wait a few more minutes and then I went inside the building but didn’t know where Sally's office was since she had moved and a gentleman who was standing in the hallway I said Sally? He pointed right inside an office near where he was standing. I did not go into the office I just stepped near the doorway and said Hi Sally I’m here to pick up the game she said ok. On the way out she said “It’s just a board I don’t know why it is such a big deal”.

We get to our trucks and she hands me 3 squeezy balls that look like they been chewed by dogs “Here’s the balls” Balls? Where are the bean bags? Patty said here’s the game as the board was lifted and put in my truck. I asked where the stand was? I explain how the game was what it had and how beautiful ly handcrafted it was.

At that point Sally started to get loud yelling about work and about the board. I made it clear that I was not getting into this at the work place while she stood there and smoked her cigarette. I refuse to make an ass out of myself and get in my truck and pull away.

Bill my witness was in the parking lot the whole time. The gentleman in the hallway I do not know.
I texted Sally 4:39 pm (phone record) exact text said: Sally you do not scare me so when you get off work…I’ll b happy to hash it out with you I have plenty to tell you unless of course you’re afraid of me and the truth
4:42 pm (phone record)you should really learn the property rules and laws. Something was made For a non profit organization and just because you had it in your garage does not give you rights to it. That game was beautiful what u gave me looks like a piece of shit. I don’t know what you think I can do with a board only and its bean bags not your dogs balls.
4:46 pm (phone record) Your story changed so many times I don’t think you know yourself what the real one is. Money was NEVER brought up you offered to make the bean bags and have the game made. Money as never brought up cause you would have Been paid. Stealing from an organization is not right and u know it.
4:47 pm (phone record)I WILL SEE YOU AFTER WORK. But at that time you will have another excuse of why u can’t talk…like always.
I have offered and showed the HR person the texts to Sally on my phone and offered for anyone else to look at them. The phone records show the date, time to & from number, direction & message type, the actual writing is on the phone. I have tried to photo copy the texts but it didn’t work. I have not figured out how to email a text.

I never threatened Sally in any way shape or form. I said I would like to talk with her as it states in my facebook. Also as it states in my facebook all that had to be done was say I do not have it and be done with it. The only thing I can think of why she may have felt afraid is because it was league property and knew she should not have done whatever really happened to it. When Sally was a part of the BOD in the past she knew in order to get league property back I had to go to court. It is up to me to pursue going to court and from previous dealings it is not worth it to me or the organization.

It also states that I was not going to discuss anything at the workplace on the clock or not. While I was picking up the board I never called her any names other than her real name Sally.
The last email I sent to Sally was MAR 2010 she was taking care of a safety book. Sally does receive emails however from a distribution list she is on that belongs to the leagues Yahoo Group. It is information that goes out to whatever parents are signed up for the group. The email she signed up with is her military email and her military email is on all of her league legal paperwork. No other email is on record for Sally.

I have no business dealings with Sally at work. I am in my office from when I start in the am to when I leave unless I am picking up tapes from "Sue"which is in a trailer at the south end of my building and that is rare. Anyone in the North End (where I work) could attest to that.

What dealings Sally and I have had have been purely through the League organization. She has children that play in the league and she was a board member for a very short time frame. What takes place within the league and its business should have nothing to do with the workplace. I simply did what I was asked to pick up a board, I tried to go to her home the previous night to pick the board up.

My life is my work and the organization that I am in charge of. If I had to step away from the league it would hurt but I would live. Loss of employment would hurt my family to the point of divorce, bankruptcy and our daughter not to finish college. Never did I threaten Sally in any way did I want to talk with her? Yes but that was it. I answer to higher up forthe league just like at the place of my employment. I cannot give answers that I don’t have or that someone refuses to give to me or avoids me.

Here is the FB I sent minus friend comments:

LAst year XXX League was going to be in attendance of the Red Ribbon Carnival and needed a game. We decided on a baseball bean bag game. Sally said she have the guys from XXXX make it for XXXXXX LEAGUE and she did it was BEAUTIFULLY HANDCRAFTED

The game is used for the carnival and it went back to your house. It took me weeks to get stuff from you that was property of the leagues. I should have taken the game that day I never thought someone would take from a non profit organization...especially one that her family participates in

NOW if I am clocked out am I not able to write whatever I want on my FB and text?? I was not waiting for her after work I never had any more contact with her. Yet 5 days later I get pulled in to HR and suspended w/out pay.

It has been a full week and I have not heard anything. How legal is all of this? Can I take Sally to civil court for loss of wages and/or my job?

Do I need a lawyer? I really need my job!!!!!!!

HELP!!!!

The people here are volunteers most will not want to read through the novel you just wrote. Canyou shorten it some?

Work day is done in 30 minutes and still nothing. Should 1 person be doing an investigation that consists of speaking to supposed witnesses and make a decision?
It sounded like the main phrase that was threatening was ”I’ll b happy to hash it out with you I have plenty to tell you unless of course you’re afraid of me and the truth”. Hash it out does not mean kick your ass!

Do I need a lawyer? I really need my job!!!!!!!

In general, most employees are considered at-will and can be terminated immediately for any reason, or no reason at all, unless there is a written employment contract in place specifying that the employee can only be terminated for cause. Sometimes "cause" is defined, sometimes not, but generally would include circumstances such as failure to meet the job qualifications, misconduct, etc. However, it is illegal to deny employment on the basis of a protected class (like race, gender, religious beliefs, etc.)
