Default Employeed by Small Buisness No Contract Pay Dispute

I work for a small trucking company in Alabama. The agreement I had with this company was that they would pay me 35% of any load that I delivered for them. The VERBAL agreement would be that I would get copies of the Brokers Ld Confirmation Sheets. The sheets have the info on how much the ld will PAY. I have not got any. Instead I have had to rely on the trucking companies WORD that the pay they've quoted me is the correct amount. I'm starting to question everything now because they arent paying me what they quoted me. Whats worse not reimbusing me for what I'be spent out of my own pocket to keep the truck running. I would like to sue them for what I feel is owed, but in order to do that I need to SUPEONA Ld Confirmation Sheets which I can only do if I go to a higher court that small claims. Would it be more than the lay person could handle to do this. Another question. I trying to think of the term I heard of earlier. It has something to do with agreement by default. Can u think of it?
