Employee used someone else's SS#-lawsuit threatened
Not sure if this is the right place to post this, but... My wife and I run a small business in GA with only three emloyees and my wife and I. We received a certified letter a month ago from an individual from CA who said his uncle was to receive disability from the govt. but cannot collect because his records list him (via SS#) as employed at our business for a couple of years he was not working. Turns out one of our employees had given us a false social security number that belonged to the guy in CA. He was threatening a law suit if we did not correct the issue. We have since received a second letter which states the following word for word: (his English/typing is not that good)
"Thank you for you is replied. However my uncle NEVER worked for your company and NEVER lived in Georgia, therefore ,I'm waiting for the result from Federal Financial Fraud Unit so I may assist you better.
Enclose is the copy of state of California driver liscence and his social security number attatched to this letter for you to re-investigate this case before court motion, however this is not civil case but it is criminal case.
Hopeful both parties are result without federal action or court action, moreover, if you have fail your re-investigating this case, therefore, the court motion shall(will) be withheld in federal court(not local).
Thank you very much for your time.
Truly yours,
XXXXXXXXX XXXXXXXX"
What is our responsibility as an employer? What do I need to do to correct the matter? Any help would be much appreciated.
