Default emergency temporary custody

My nephew moved in with me six months ago. His father contacted me and told me he has sex with his 15 year old girlfriend and that the parent was going to file statutory rape charges against him. He was pulled from school in Washington and failed the last half of the year. I did find out from the girlfriend and the mother that none of what was said was true. I have been taking care of him since. My nephew wanted t finish high school but when we asked his father to assist us he would not allow him to register for school. My nephews mother gave me the required documents so that I could register him. He has now been in school for three month and we have signed him up for on line schooling to make up all the needed classes so that he can graduate. He is just starting to get his life back together and making friends. He has started to become more serious about school after this dramatic event and the move. His father has sent $280.00 for his care in six months. He return to Arizona this week and is now wanting to take him out of school again. He has no reason to do this except for a power issue. he has no job and my nephew does not want to go. He has contacted my nephew two time a month since he has arrived. They do not get along and my nephew is always in trouble even though he is a great kid and really does nothing wrong. His mother wants him to remain with me as she feels that this is best for her son and his future. I do not have children of my own and do not know what I can do. I want him to stay in school and have an opportunity in this life. I contacted child protective services and they told me to file for Emergency Temporary Custody. However they said I most likely would not get it. Do I have any rights in order to help this kid. He would like to go for Emancipation. What are my options?
