Default Elderly incompetence

I have two elderly uncles who live in a town in Arizona 7 hours away from me. For some time, the oldest who is 91 has not answered the phone. I have left messages, and sent him mail, but still cannot get him to answer. The other uncle, who is 90, lives across town from him and he's been telling me that the older is ok, he's talked with him. Neither of these uncles ever had any children, there were three of them originally, my dad, the oldest, died 7 years ago. The younger of the two is married, (she's 87) and in frail health as her husband also is. I have three brothers, all who live either 1000 or 2000 miles away and I am the youngest in my group. None of them have had any communication with this uncle in years, and don't particularly care for him. Last night I got a call from the aunt. She reports to me that they went over to the house of the other uncle and the house is filled with trash to the ceiling, and they don't know what to do. She mentioned trying to find him an apartment in a retirement village but that someone (meaning me) would have to take care of things. What should I do? What would it take to have him declared incompetent and be able to handle his affairs for him? I work in the schools and so I have the summer off, but if I am going to do this, I must start immediately to get things done for him. I have no idea if he has any money or not, but I feel morally obligated to try to do something for this situation. Thank you for any advice. Nurseloo

I know this is a frustrating situation for you and your family. I would suggest that you speak with an attorney that handles this type of situation. You can locate one through the attorney locator on Lawinfo's home page at http://www.lawinfo.com/. Some do offer free consulations.

I guess that what I need to do first is to assess the situation for myself, including his mentation and the state of the home. Then I will try to determine what needs to be done. Thanks for your input, I know I'll have to eventually do something and get some legal advice, but I must know exactly what the state of the home is first. nl
