DUI Citation arrest
I notice none of these posts have replies, but I will try my question any way.
My husband was in a accident, and sustained a head injury. When EMS arrived, they asked if he had been drinking. He told them he had, 1 beer and a shot of liqour about 5 hours prior....No tests were administered at the scene. When questioned by police at the scene they only asked if he was seriously injured and if he had insurance info. husband was then taken to the ER in an ambulance, where ppolice then questioned him only about the DUI and not the accident. Then they told him he was under arrest pending blood test results. Later when I had arrived police handed me a report that stated citation arrest. and said pending blood tests he would be taken into custody or dismissed. All blood tests came back NORMAL, my questions are #1 will the fact that he was tested for DUI have any effect on the accident investigation and #2 Will the DUI remain on his record even though his blood levels were normal? Any answers or ideas would be helpful.

He wasn't convicted of the DUI was he? If not, it shouldn't be on his record anywhere. If his tests were normal, I can't see how it will hurt him if they are involved in the investigation.

Hi, you dont have anything to worry about! The officers were probably hoping that he was intoxicated in order to get another notch on their belt. This will have no bad affect on your husbands record! Just shows that their "hunch" was wrong. You should serve them a back lash and accuse them of not aiding to your husband appropriately.

Write to the court and ask for a hearing

Ask for a hearing immediately CALL. Have your husband show up at pretrial tell them he had 1 beer and a shot 5 hours prior, that the blood alcohol levels were normal that he was not intoxicated whatsoever. That one beer is equal to a shot is equal to a glass of wine. and for every one hour that goes by you lose one beer, shot, or glass of wine, so after two hours he was not only not drunk but that there shouldn't of almost certainly been abnormal if an alcohol in his blood. Make sure the judge doesnt convince you it was because of the alcohol because your allowed to drink and drive just not be impaired. He will ask if you felt impaired so charges or no charges. Don't drink the same day you drive is always a good modow. Brian
