Question How do I recover deposit $'s from private party?

I paid $400 cash deposit for used cabinets for my kitchen remodeling project ... but the sellers are now not returning calls.

The cabinets I was purchasing were installed in the home of the sellers ... who were in the middle of their own kitchen remodeling project.

I agreed to purchase their used kitchen cabinets for $1,200. The deal we had is that I was to pay the balance of $800 when theiir new kitchen cabinets arrived in a few weeks.

I gave them the $400 cash deposit in Jan 2006 ... and believed their many BS excuses about construction delays for most of last year. As a result, I've had to make other arrangements for my own cabinets; and, at this point, I would simply like to recover my $400 deposit.

Unfortunately, with the seller's home being located in a "gated community" (Biltmore Estates), I don't even have the option of confronting them face-to-face to request a refund of my $400 deposit.

I'm angry not just because they'e ripping me off ... but, in particular, because they're ripping me off while enjoying an oppulent lifestyle. My sense is that $400 is not a significant amount of money to them ... but it is a lot to me!

The sellers gave me a handwritten receipt for my $400 deposit which I am trying to find ... but I'm not certain I will.

I'm hoping for advice as to what I should do if:

1 - I find the receipt

2 - I don't find the receipt

Without the receipt it will most likely be your word against theirs. I would suggest that you contact them telling them you want your money back. You could always file a small claims suit against them.
