Default Divorced Father died Intestate in Kentucky

I will start with, my DIVORCED father passed away INTESTATE December 27, 2008 in Kentucky and there was no possible way that I could attend the funeral, or be in Kentucky until February, so it has became a mess.

I contacted my uncle once I came back to Kentucky, to pick his brain, and he basically wasn't saying anything about what I should receive from my father's estate, so I began some research and found out that my brother (who lives in Las Vegas), and my uncle, filed papers for my uncle to become the administrator of the estate and both said my brother was the only heir.

I then hired a lawyer (who wants 1/3 of what I receive) and he began filing motions for me to honored as an heir (with the paternity test results from when I was 9-years-old attached) and had set a hearing for the judge to honor me as an heir and for the uncle and brother to have an inventory of the estate.

A day before the hearing was set, I contacted my uncle again and he fed me full of crap saying my father's ex-wife was still on his savings account and took $11,000, and my father's checking account had $27,600 in it, but he paid his bills and there was basically no money left. He also said that they were willing to settle this out of court and give me half of what the house was worth, but mentioned nothing of the vehicles. After some words, I began thinking and made a trip to the county clerks office, again..

He stated that my father had signed his four vehicles over to him before he passed away. When I went to the county clerk and the information on the vehicles, they were registered to him on the date of his death, but were transferred into my uncle's name the following month (January). I have came to the conclusion, that the only way this was done, is my uncle had a Notary post date the signature on the title before my father passed, and had someone else sign it. Dad didn't expect to pass away and there is NO WAY he would have transferred the titles on his vehicle over to my uncle.

When I gave my lawyer notice of this, he didn't seem too interested and didn't say much. He is being way too slow and isn't informing me of anything. I have yet to pay him anything, or sign a contract.

Can someone give me some advice? What should I do? If I were to tell my lawyer that I no longer need his services, would I have to pay him? He has only filed a motion for me. Any information would be appreciated.

I can understand that this is frustrating for you. Have you browsed through the information in LawInfo's Free Legal Resource Center to learn more about your issue yet? See: http://www.lawinfo.com/consumer.html. You can certainly try to speak to another lawyer to determine what legal options may be available. As for your present attorney, you really will need to talk to him regarding payment. In the meantime, you may be able to learn more on your own. Search the "Free Legal Resources" tab, or browse the Consumer Resources. Good luck.
